In a unanimous opinion dated February 22, 2019, the Supreme Court of Texas reversed a multi-million dollar judgment against firm client Mercedes-Benz USA LLP and rendered judgment that the plaintiff—south Texas auto dealer Carduco, Inc.—take nothing.  The 2013 trial-court judgment against MBUSA was for over $130 million.  EBBK lawyer Joe Knight led MBUSA’s appellate team in the court of appeals, which reduced the judgment to approximately $16 million.  Both sides petitioned the state Supreme Court for review, and Knight argued the case on December 4, 2018.

EBBK represented several owners of Stubb’s Austin Restaurant Company, which owns Austin’s legendary Stubb’s Bar-B-Q and live music venue, in a dispute over control of the company.  Joe Knight presented the case to a private arbitrator.  On November 21, 2017, the arbitrator issued a written decision in favor of the firm’s clients, confirming their majority ownership position and control over the company’s Board.
